Terms and Conditions for Malvern College Summer School Day Camps Programme

Definitions

  • Malvern College Summer School / We / Us /Our means Malvern College Enterprises Limited trading as Malvern College Summer School. Malvern College Enterprises Limited is a private limited company registered in England with company number 02706656 whose registered office is at College Road, Malvern, Worcestershire WR14 3DF
  • You / Your means the person/s who have submitted the completed application form for place on the Course
  • Course means the Summer School Course provided by Us to the Student
  • Course Director means the person appointed by the Directors of Malvern College Enterprises Limited to be responsible for the day to day running of the Course.
  • Student means the student named in the application form.
  • Fees means the fees payable for the Course by You and includes the Deposit and certain insurances.
  • Deposit means the initial deposit payable by You in accordance with these terms and conditions.

Enrolment

  1. Places on each course are strictly limited and subject to availability, as well as Malvern College Summer School’s ability to meet and continue to meet the Student’s needs.
  2. Enrolment is only valid once the full course fee has been received and written confirmation of the Student’s place has been issued by Malvern College Summer School.
  3. Upon receipt of full payment, You and the Student will receive course details. Please note that the Course Director may make reasonable changes to the programme as necessary.
  4. You confirm that all information provided is complete, accurate, and up to date. (See Section 2: Cancellation and Termination for consequences of providing incorrect or incomplete information.)

Cancellation and Refund Policy

  1. No refunds will be issued for cancellations made within 14 days of the start date.
  2. Malvern College Summer School reserves the right to cancel or reschedule due to unforeseen circumstances. In such cases, a full refund or credit will be offered.
  3. If at any time after completion of the application, We find the information to be incorrect or inaccurate or incomplete We reserve the right to terminate this agreement with immediate effect and to require the Student to leave the course. In this case, there will be no refund of the course fees.

Health and Safety

  1. Parents/guardians must disclose any medical conditions, allergies, or special needs during registration.
  2. Campers must be free of contagious illnesses to attend.
  3. In case of emergency, the summer school staff will take appropriate action and contact the parent/guardian immediately.

Behaviour and Conduct

  1. All students are expected to behave respectfully toward staff and other students..
  2. Bullying, aggressive behaviour, or repeated misconduct may result in dismissal from summer school without a refund.
  3. Parents/guardians will be notified of any behavioural issues.

Drop-off and Pick-up

  1. Students must be dropped off and picked up at designated times.
  2. Late pick-ups may incur additional fees.
  3. For safeguarding reasons, only authorised parents or guardians are permitted to collect their child from the premises, and these names can be provided on the Personal Information Form or in writing at a later date.

Liability and Insurance

  1. Malvern College Summer School holds public liability insurance.
  2. Any liability to the Student or parent/guardian is limited to the amount covered by this insurance.
  3. Nothing in these terms excludes or limits liability for personal injury or death caused by negligence.

Events Beyond the Control of the Parties (Force Majeure)

  1. A Force Majeure Event includes, but is not limited to:
    • Natural disasters (e.g., flood, earthquake)
    • Epidemics or pandemics
    • War, terrorism, civil unrest
    • Government actions or legal restrictions
    • Fire, explosion, or structural collapse
  2. If a Force Majeure Event prevents or delays performance of obligations, the affected party will not be held liable. Obligations will be extended accordingly.
  3. The affected party must:
    • Notify the other party as soon as reasonably possible, detailing the event and its impact.
    • Use reasonable efforts to mitigate the effects of the event.
  4. Reasonable adjustments to the course to comply with legal or health guidance will not affect Your obligation to pay course fees.

Photographs and Videos

  1. By enrolling, parents/guardians grant permission for the camp to use photos or videos of campers for promotional purposes unless otherwise stated in writing.

Consents

By accepting these terms and conditions, You consent to the Student participating in all excursions and activities listed in the programme.
